El presente artículo de reflexión es el resultado de una investigación que tuvo un enfoque metodológico cualitativo que se expresó en dos dimensiones: uno analítico-conceptual y otro crítico-hermenéutico, y está dirigido primordialmente a examinar el problema de la obediencia moral al derecho desde los presupuestos teóricos y conceptuales de la ética normativa. Sosteniendo como tesis principal que la ética no puede equipararse a una moral aplicada, en la medida que esto implicaría confundir la ética con la moral y por el (...) contrario, el cumplimiento de las normas se da por ser lo moralmente correcto, en consecuencia, será posible concluir a través del presente trabajo que existe una obligación moral de cumplir el derecho, salvo juicios morales concretos frente a ciertas regulaciones de conductas establecidas por normas que no estén acorde a los valores críticos o morales. Since male CEOs dominate corporate leadership, the literature on top management decision making suffers from an implicit masculine bias. Although research indicates that males and females are biologically and psychologically different, the leadership characteristics of female CEOs are largely unexplored. Two of these characteristics, risk aversion and ethical sensitivity, are tied to key accounting issues, such as conservatism in financial reporting and steadfast opposition to fraud. In this study, we examine the relationship between CEO gender and accounting conservatism, and find (...) a positive association between the two. Consistent with conventional wisdom, this association appears to be stronger in firms with high rather than low litigation and takeover risks. This study contributes to the ethics literature by highlighting the benefits of gender diversity in upholding the integrity of financial reporting. (shrink)

IntroductionThe 2019–2020 pandemic COVID-19 has become a global health crisis. While many recent studies on COVID-19 pandemic have focused on disease epidemiology and psychological status of patients, few have explored the multi-facet influential factors or combined perspectives from both the patients and healthcare workers. The purposes of this study were to: analyze the influencing factors of psychological distress of COVID-19 patients; and describe the experience of healthcare workers relieving psychological distress.Materials and MethodsThis study uses a mixed-method cross-sectional design, including a (...) quantitative study and a qualitative study, targeting two populations: COVID-19 patient and health workers, respectively. In the quantitative part, we recruited a convenience sample of patients with COVID-19 from five hospitals in Wuhan, Hubei Province from 10 to 15 April, 2020. Besides, we collected data by using participants’ socio-demographic information sheet, the Connor-Davidson Resilience Scale-10, the Herth Hope Index, the Distress Thermometer, the Revised Chinese Version of Mishel Uncertainty in Illness Scale, and the Chinese Version of Wake Forest Physician Trust Scale. In the qualitative part, the participants were healthcare workers involved in medical aid missions in Hubei Province, China. Meanwhile, we used sampling with convenient and purposive, data collection with a semi-structured online video interview, and text transcription with Colaizzi’s phenomenological method.ResultsThe results reveal that 25.7% of patients reported higher level of psychological distress. After controlling the sociodemographic variables, only severity of COVID-19 and uncertainty in illness shown significant effect on psychological distress in the regression model. The experience of healthcare workers emerged five themes: Particularly needed psychological care, Manifestation of negative emotion, Manifestation of proactive adaptation, Strategies relieving psychological distress, and gains of healthcare workers after delivering effective psychological care.ConclusionThe 25.7% of patients with COVID-19 still suffered from psychological distress, which should receive timely attention from healthcare workers. And the severity of the disease and disease uncertainty have a significant impact on distress. It is critical to train the healthcare workers on detecting the different manifestation of psychological distress, offering timely disease related information, and applying communication strategies. La supervision individuelle ou en groupe permet à tout thérapeute formé selon les concepts théoriques et l’approche clinique de la psychanalyse de forger ses propres outils. Dans un groupe de supervision, chacun apporte les difficultés sur lesquelles il bute dans la mise en place et le déroulement d’une thérapie. Le groupe réfléchit, dans tous les sens du terme, ce qui permet au thérapeute de percevoir ce qui jusque là lui échappait – qu’il s’agisse du fonctionnement symptomatique des patients entre eux (...) ou de ce qui se passe entre eux et lui lorsque s’éclairent les mouvements du transfert. Le groupe est à la fois environnement sécurisant, structure et appareil de liaison, la groupalité étant une dimension du sujet. Tout se passe comme si l’appareil psychique groupal reprenait à son compte le travail d’élaboration psychique du thérapeute, qui, pour le moment, se plaint de ne plus avoir la capacité de penser. Le superviseur est garant du cadre. De lui dépend également la spontanéité et la qualité des échanges ainsi que le climat de confiance indispensable au plaisir de travailler ensemble dans un rapport de parité. (shrink)

À partir d’une situation de couple dans lequel la communication semble bloquée par un trop plein de souffrance, due en partie à des traumatismes dans les liens de filiation de part et d’autre, l’auteure, grâce à un groupe de recherche, expérimente la nécessité d’un nouvel espace pour réguler un transfert massif. This paper analyses the way in which discourse and argumentation may vary depending on participants’ educational level and gender. Men and women from three different educational levels (literacy, advanced level and university students) participated in discussion groups that debated about women and work, the sharing of housework and the way in which girls and boys are educated. The results showed important differences depending on participants’ educational level and gender. L’écoute d’un couple en crise qui demande à être aidé montre fréquemment que la dégradation de leur communication affective et sexuelle a débuté à la naissance d’un enfant, pas nécessairement le premier. Quelques exemples témoignent à quel point de multiples remaniements psychiques s’opèrent au sein du couple, lorsqu’une femme devient mère : retour de l’enfant en soi, réactivation des conflits œdipiens. Et, comme le souligne Winnicott, n’y aurait-il pas en chaque homme et en chaque femme la représentation d’une femme/mère toute-puissante (...) et dominatrice, source d’angoisses multiples? Cette peur de la femme, qu’il faut donc à tout prix dominer, semble évidente lorsqu’on écoute les représentations que les adolescents se font de l’autre sexe. This article examines the impact of ChatGPT on judicial reasoning, focusing on a recent Colombian case where the judge utilized ChatGPT in the decision-making process. The case, decided in January 2023, provides a unique “pilot case study” on the subject, as the judge, in the decision, openly referenced the questions he posed to ChatGPT and the responses of the system. La demande en thérapie de couple revêt souvent la forme d’une plainte. Lorsque l’on s’attache à travailler les éléments conscients et inconscients qui structurent le transfert, on mesure à quel point cette plainte est séductrice. Elle exerce sur le thérapeute une emprise directe qui peut modifier son écoute et paralyser le processus thérapeutique, car elle a le pouvoir de s’introduire au cœur de son monde interne.

Discussion of modeling within philosophy of science has focused in how models, understood as finished products, represent the world. This approach has some issues accounting for the value of modeling in situations where there are controversies as to which should be the object of representation. In this work I show that a historical analysis of modeling complements the aforementioned representational program, since it allows us to examine processes of integration of analogies that play a role in the generation of criteria (...) of relevance, which are important for the configuration of the object of research. This, in turn, shows that there are norms in modeling practices whose historical reconstruction is relevant for their philosophical analysis. (shrink)

Background: The coronavirus disease 2019 pandemic is impacting the delivery of healthcare worldwide, creating dilemmas related to the duty to care. Although understanding the ethical dilemmas about the duty to care among nurses is necessary to allow effective preparation, few studies have explored these concerns. Aim: This study aimed to identify the ethical dilemmas among clinical nurses in Spain and Chile. It primarily aimed to (1) identify nurses’ agreement with the duty to care despite high risks for themselves and/or their (...) families, (2) describe nurses’ well-being and (3) describe the associations between well-being and the duty to care. Research design: Cross-sectional self-reported anonymous data were collected between May and June 2020 via electronic survey distribution (snowball sampling). Ethical considerations: The Institutional Ethical Review Committees in both countries approved the study (CHUC_2020_33 and 27/2020). Findings: In total, 345 clinical nurses answered the primary question about the duty to care for the sick. Although in the total sample 77.4% agreed they have a duty to care for the sick, significant differences were found between the Spanish and Chilean samples. Overall, 53.6% of the nurses reported low levels of well-being; however, among those reporting low well-being, statistically significant differences were found between Spanish and Chilean nurses as 19.4% and 37.8%, respectively, disagreed with the statement regarding the duty to care. Discussion: Participants in both countries reported several ethical dilemmas, safety fears, consequent stress and low well-being. These results suggest that prompt actions are required to address nurses’ ethical concerns, as they might affect their willingness to work and psychological well-being. Conclusion: Our findings shed light on the ethical dilemmas nurses are facing related to the duty to care. Not only has the coronavirus disease 2019 pandemic given rise to ethical challenges, but it has also affected nurses’ well-being and willingness to work during a pandemic. (shrink)

Comment départager ce qui est à travailler au sein du groupe thérapeutique et ce qui ne nous regarde pas, nous thérapeutes? Autant de frontières entre l’autre et soi, entre les motivations conscientes et les désirs inconscients, qui sont à la fois signifiantes et difficilement repérables. Le travail du thérapeute sur son contre-transfert lui permet de faire la différence entre ce qui ne le regarde pas et ce dont il préfère ne rien savoir.

En este escrito intento exponer la manera en que establezco una relación entre la filosofía de la ciencia social y la teoría social. Lo anterior se da “incidentalmente” a partir de mi propio trabajo en teoría social; el cual se origina en la Teoría de la Estructuración de Anthony Giddens y actualmente involucra al Naturalismo Crítico. Mi interés original en la teoría social, el cual giraba en torno al trato que Giddens le da a la dualidad agente-estructura a través de (...) su Teoría de la Estructuración, me llevó a conocer la teorización social realista de Margaret Archer. De esa forma me comienzo a empapar del Realismo Crítico de Roy Bhaskar, que en su vertiente filosófica fundamenta la teoría social de Archer, y eventual y necesariamente, como parte de mi interés actual por analizar la teoríasocial realista, empiezo a involucrarme en la discusión contemporánea de la filosofía de la ciencia social. Una primera lección que me deja dicho ejercicio, la cual ejemplifico con ciertas puntualizaciones respecto al (que considero) deficiente trato que dicha filosofía recibe en y por parte de mi academia, es la necesidad de hacer explícito (de pensar un poco en) el trasfondo filosófico que subyace toda teorización social. Ya que creo que muchos de los problemas originalmente achacados a esta última pueden ser atajados, de forma satisfactoria, desde su contraparte filosófica. (shrink)

Using a cross-modal semantic priming paradigm, both experiments of the present study investigated the link between the mental representations of iconic gestures and words. Two groups of the participants performed a primed lexical decision task where they had to discriminate between visually presented words and nonwords (e.g., flirp). Word targets (e.g., bird) were preceded by video clips depicting either semantically related (e.g., pair of hands flapping) or semantically unrelated (e.g., drawing a square with both hands) gestures. The duration of gestures (...) was on average 3,500 ms in Experiment 1 but only 1,000 ms in Experiment 2. Significant priming effects were observed in both experiments, with faster response latencies for related gesture–word pairs than unrelated pairs. These results are consistent with the idea of interactions between the gestural and lexical representational systems, such that mere exposure to iconic gestures facilitates the recognition of semantically related words. The eukaryotic genome is organized into different domains by cis‐acting elements, such as boundaries/insulators and matrix attachment regions, and is packaged with different degrees of condensation. In the M phase, the chromatin becomes further highly condensed into chromosomes. The first step for transcriptional activation of a given gene, at a particular time during development, in any locus, is the opening of its chromatin domain. This locus needs to be kept in this state in each early G1 phase during every cell (...) cycle. Certain distal enhance elements, including locus control regions (LCRs) and enhancers, are believed to perform this target chromatin domain opening process and several models have been proposed to explain distal enhance action. But they did not explain precisely how a given chromatin domain is opened. Based on various studies, we propose a hypothesis for the mechanism of opening chromatin on a large scale. One important mechanism may involved breaking one or two DNA strands and reducing the linking numbers within chromatin domain. The topological changes can overpass some complexes formed on DNA strands and can be transmitted from specific localized points over a broad region, until boundary elements or insulators are reached. These may initiate downstream events such as propagation of histone acetylation and the binding of transcription factors to proximal promoters and may further augment the action mediated by distal enhancer elements. Por meio de uma revisão integrativa, busca-se identificar, dentro da produção científica brasileira, artigos que fazem intersecção entre os temas do luto e da velhice, sob o olhar da psicanálise. Desta forma, se visa estabelecer qual o enfoque dado ao idoso e qual a visão apresentada pela psicanálise para um trabalho com esta população que se encontra mais propensa a rupturas e perdas. Assim, se reconhece que há uma identificação de morte e finitude vinculada à figura do sujeito que envelhece, (...) mentalidade adotada pela lógica de consumo. Identificou-se de que forma as inúmeras perdas aliadas ao envelhecimento suscitam no idoso um processo de luto que, segundo a psicanálise, pode ser definido como o afeto resultante da perda de um objeto libidinal. Verifica-se, assim, a importância de um acompanhamento aos idosos que vise desobstruir a via do desejo e criar novas perspectivas de vida, sobretudo nesta fase do desenvolvimento, que como todas as outras, possui características e desafios particulares.
